Litigation Strategy - a Preliminary Look
Litigation strategy for a client depends on many things, including the quality of the claims or defenses, the amount of money available to pursue the claims or defenses, the need for speed or delay, the prospects and desire for settlement, and the willingness to accept higher risk in return for a substantial reduction of litigation expenses. There are many other factors, such as the existence and quality of witnesses; the amount of damages; availability of punitive damages; effect of publicity; importance of the case to an industry or defendant; the need and anticipated cost of expert witnesses; the status of the legal points involved and whether there is any conflict between circuits; choice of court; choice of venue; and other factors.
